HMA Pavement Repairs The above public work will be let to the lowest responsible bidder and shall be performed in accordance with the plans, specifications and contract now on file in the office of the Director of Public Works. No bid shall be received or considered unless accompanied by a certified check equal to five (5) percent of the bid or bid bond in equal amount payable to the City as a guarantee that, if the bid is accepted, the bidder shall execute and file the proper contract and bond within ten days from the date the lowest responsible bid is accepted. In case the bidder fails to file such contract and bond within the time set by the City, the check or bid bond shall be forfeited to the City as liquidated damages.
